I’ve been incredibly busy. Right now I’m working on two more campaign ads (you may have seen the first one - if not, here it is).
I’m also trying to “Roger and Me” George Allen whenever I can. And all of this is on top of a full 1L schedule at UVa…
So yeah… I miss doing this stuff - it seemed that at least once a month, something would happen that really got the adrenaline flowing… I miss those tasty morsels of victory.
But hell… hopefully we’re about to get the main course. Get out and vote Tuesday. Bring ten friends.
And after we’ve taken the Congress back… hold our leaders accountable.
And do me a favor… Listen to Rush and Hannity and O’Reilly on Wends. Gloat a little for me… Enjoy their anguish. I sure as hell will.

I’m torn between calling up and saying “Ha Ha Ha” or “Ha Ha Ha Ha”. The latter would seem to be gloating a bit too much. Still, the last time we thought there was a lock on votes, we find out there’s shenanigans going on election night.
I’ve no problem if a man or woman I disagree with gets honestly elected. When those in power take the “elections bend to my will or I neuter them” mindset is when I get angry.
Let this new Congress do something to clean up national elections and control gerrymandering.

I guess you hit a nerve with your question, although the video in NBC29 didn’t seem to have audio. It took three of Allen’s staffers to take you down! Those staffers should adopt the same diet, sleep, and workout regime of a first year law student at UVA that you’ve adopted. Keep up the good work and good luck at school.

Mike, it appears you’re doing a good job gathering media attention. (Just read about you in the RTD.) But what are you adding to the campaign? With all of the serious issues in the world (and I absolutely agree that the candidates don’t discuss them in detail enough), how do attention-grabbing tactics like asking Allen about spitting at his wife or using racial slurs decades ago shed any light on anything of any importance in this election? I would think you’d want to do something more constructive than acts that are just going to be ignored and get you booted from events.

From CBS 19:Allen was approached by a man and asked why he had spit in the face of his first wife. After Allen did not answer, the man became aggressive and Allen staffers and supporters tackled him to the ground and forcibly removed him from the hotel.

7:00 pm Oct 31 - Channel 9 news out of DC ran the Mike Stark/Allen story at the top of the broadcast. After showing the video (which is longer than the one posted online), the two anchors did anchor-banter. Derek McGinty asked the other anchor what it was Mike Stark said that caused the goons to declare “now you’re getting personal”. The other anchor said Mike asked if Allen spit on his first wife. He quickly added that he didn’t know where that accusation came from. Here’s the good part; Derek McGinty then said, “Well, at the risk of getting personal, this may well bear looking into.”
The story might have legs.
This is getting play on the other blogs. Orcinus has a story up about these Republican thug tactics, which are nothing new. Remember the “spontaneous” protest in Palm Beach in 2000, goons bussed by Tom DeLay from the D.C. area?

If you were assaulted, you pick up a phone and report it to the police.
They come out and, depending on witnesses, arrest somebody.
Was this done? Why not?
Interesting. Of course, publicity for you is important here; reaping a monetary gain far in excess of any harm suffered is also key, apparently.
Of course, the action will fall on the staffer(s) rather than Allen. Your behavior makes you an easy target for claims that the staffers acted reasonably, that your violence in pursuit of Allen–shoving others, pushing forward quickly–rendered you a credible threat to a U.S. senator. Your words, while irrelevant and reprehensible, are of course protected speech. But since you did not merely shout them from afar, your suit is likely to fail. Even if you do succeed in convincing a jury to award damages, as you will learn once you are out of 1L (assuming your grades permit you to continue at UVa Law), jury trials are about assigning blame and convincing a jury that regardless of the law, the ‘attack’ on you was undeserved. Illegal it might have been, but most jurors will view it as a case of ’smart mouth got what was coming to him’–nominal damages set at $1.
Interesting, also, that so many here characterize the response to you as “Republican brutality.” I recall seeing video of far less offensive members of the press and public being treated just as roughly, if not more so, by Cynthia McKinney’s staff not long ago.
You have succeeded in creating some bad press for your disfavored candidate by taunts and offensive behavior, which provoked an uncivilized, if more or less justified, response from the staffers. Congrats, buddy… you are an excellent case in point of gutter politics.
P.S. I have read some of your writings, both here and in other online publications. Judging by the intellect revealed therein, you can ill afford to be skipping classes during first semester of 1L at UVa Law. Gods help you if you have Jody Kraus for contract law; horresco referens. Um, civil battery is an offensive touching, it does not have to be harmful, or cause harm. There has to be intent, but intent to commit the act of the unwanted touching is sufficient, the plaintiff does not have to show that the defendant intended harm.
Assault and battery usually refers to a criminal charge. I am assuming you already know this, John?

I’m from Michigan and DeVos has looked terrible in each debate so I will be voting for a Democratic Governor. I vote for who I think is the best candidate. I’m the person who’s vote can be won. Did you spit on your wife, not really something that would cause me to vote for Webb. Allen was screwing up the election just fine on his own, but now the notion of crazy liberals will cause some swing voters to go with Allen. This episode did cause me to come read some of your posts. Some good, some bad. I agree the Democrats will win elections through the 08 elections more than likely. But what then? The next couple cycles people will be voting against the Republicans not really for the Democrats. The Democratic leadership needs to have a real plan to continue to win elections after that. Our country is generally in the middle on most issues. The Republicans stay centered on most things and that will bring people back to the Republicans. The Democrats generally what to push every issue way off center and that loses them votes. Just my opinion and you see I’m not calling anyone a loser. Freedom of speech is great. I don’t really see how asking a candidate if he spit on his wife is defending the Constitution. I agree that it’s great he’s taking an active role in the political process. I just wish we could influence people to make the system better, not just try to embaress and fluster people we don’t agree with. I’m from Michigan, Michael Moore is not really a good role model. Thanks for bringing sainty to the discourse. I think America could learn alot more by people like you and I, who fundamentally exist on different sides of basic political issues, yet can rationally discuss policies and values without digressing into calling opponents “America Haters” or “Terrorist Appeasers”.
Allen went after Jim Webb over fictional passages Webb wrote in a book, and in the process sent the Virginia Senate race spiralling into the sewer. IMHO, since Allen opened the issue of personal character, I feel Mike has a right to ask about prior arrest records. Since Allen has opened the door by accusing Webb of having a negative opinion of women in general, then Allen needs to open his closets and show that his thoughts are pure. The notion that Allen has a violent temper is real and documented. How he treated his ex-wife is fair game for people to ask since it was Allen who pushed that door open in the first place. Does he have to answer the question? That’s up to him…he could have said “I refuse to answer a question that inane.” and the situation would have diffused. His staffers, instead, assaulted the questioner….not a smart thing to do in the first place, a silly thing to do during a political campaign, and thoroughly assinine when it happens in front of television cameras.
Now, instead of just saying that the incident was “under review” and the staffers involved have been temporarly removed from public contact pending the outcome of the investigation, the Allen camp is trying to sell that Mike was “a danger” to the safety of the candidate, and therefore, their physical actions in the altercation were justified. Bad move. It made it look like Allen was running away from the subject, and worse for Allen, It gave the story at least two to three days more legs…and dozens more times that the tape will run on National cable and network broadcasts, not to mention every local news outlet in Virginia, …National exposure of this nature is not something that you want in the final week when you are trailing in the polls.
Secondly, What I feel is the largest single problem today in American Politics are political commentators like Hannity, Limbaugh and O’Reilly, who co-op “traditional” American values to mean only THEIR beliefs, and label themselves “Great Americans” and “Culture Warriors”, fostering the impression that anyone who disagrees with their opinion is UN-American. They are too interested in wrapping their opinions in the flag…opinions that are often bigotted and politically motivated, and are ironically AGAINST the very values the flag stands for.
These people are doing more damage to the American Political environment, as well as the fabric of our democracy….polarizing and encouraging hatred of anyone who confronts their set principles. They breed that hatred, and it comes to a boil causing confrontation, but in the end, solving nothing. Sure, there are people on the left of the spectrum, like Michael Moore who do the same, but the far right currently has ten times the audience, and therefore, is responsible for 90% of the problem as it exists. They need to be exposed for what they are. America needs a Joseph Welch for the new century to stand up to the McCarthy-esque tactics of bullies like O’Reilly and Limbaugh to say “You have done enough. Have you no sense of decency sir, at long last? Have you left no sense of decency?”

First, I believe that Mr. Stark has a right to ask any question he wants without being assaulted. If it’s stupid or inappropriate, that reflects on him.
Secondly, I haven’t followed this race on a daily basis, but I’m aware that Mr. Allen’s attitude towards women (and spitting at them) has come up before and, as noted Mr. Allen’s people have questioned his opponent’s views. I happen to think how someone handles interpersonal conflict is relevant to a government position. I think it’s also fair to ask why records that are normally public for the rest of us are not in Mr. Allen’s case.
Last, in watching the video it’s clear that Mr. Allen was in danger of nothing but being close enough to Mr. Stark that he could not reasonably deny hearing the question. It’s also clear that the aggression was one way and that Mr. Stark was out-numbered. It must have been very frustrating dealing with him all these weeks. Anyone would be angry, but sorry, wrong way to handly it. Another problem with Allen’s judgement?
Before signing on this site, I did some research about Mike Stark. I thought he seemed like someone who is willing to be unpopular to stand up for his beliefs and to do more than just gripe. We all should do more to demand answers to our questions from people who say they want to work for us. We should not be content only to watch their slick ads and listen to their half-truths and smears. Since yhe media will not confront their lies, we should.
Last thing, I promise. When I first started reading the comments, I was so impressed. They were addressed to Mr. Stark and on point. When the usual hate-fueled, waste-of-time name-calling, baiting and labeling started, there was simply no response and for the most part that continued. I really liked that. Isn’t there a place to talk about ideas and actions?

I watched the Eyes On The Prize documentary on PBS recently. As I watched a Civil Rights activist who was giving no physical resisance being brutalized exclaim, ” I’m willing to be beaten to get democracy “, I couldn’t help but wonder how many of us, when push comes to shove, would have his courage. Thanks to your example, Mike, I know now that courage is still alive and well in this country. We cannot let those who were beaten, unjustly arrested, or killed have made their sacrifices only to have a hate spewing bigot like Allen set back democracy 40 years. I can’t wait to see Virginia give Allen and his thugs their walking papers.

I also want to let you know that I’m an Indian-American living here in the Commonwealth. My brother is a senior at the undergrad level at UVa. I became a Democrat in ‘99 when the GOP no longer was interested in balanced budgets. This was a decision that occurred after years of being frustrated with matters like the politically-motivated Paula Jones civil suit and, yes, the hostility many GOP members have toward diversity.
Even if I wasn’t a resident of Virginia, I would still think that Allen is the most miserable member of the Senate. He is the Senate member most like Limbaugh and his listeners in his views. I’m fortunate enough that I can vote him OUT! Let’s win this fight everybody!
I think Mike can be considered rude for trying to ask the question, but the video shows a clear overreaction. It’s most likely they knew Mike was the guy who started the ‘n-word’ story, and were scared to death what else was going to come out of his mouth so they had to take him down asap. As for law, respondeat superior can work in a civil case to tie the employer to his employee’s actions, as for damages at least, so Allen should be included as a party in the suit. “Assault” in a tort case can be based on any behavior, even words, that put another in a state of fear of immediate serious physical harm. They should be expected to counter with that, but from the video I don’t think that argument would go far. On the whole, something more high-minded could have been more effective, like asking about support for the war, but as some have mentioned, the Republican machine had decided a while back that this election cycle was going to be about whispering dirty little personal things about the opposition, so it’s about par. Also, I think a lot of divorce records are sealed for family privacy, and appropriately so.

This incident is really just appalling. I mean, it reminds me of images from Germany in the 30’s - hired goons and thugs attacking citizens who dare to question their elected officials. In any event, citizens of this country are still permitted to ask inappropriate questions without being assaulted.

Allen and his staff could have handled it better. Just about anything else would have made him look better. Allen for President is done. Polls show Allen should lose this election, but of course turn out will determine the winner and in a mid-term election you just never know how many will vote.

He didn’t initially apologize because he knew, just like everyone else in this country should have known, that he was bashing on Bush when he made the comment, not our troops. In the second sentence, Kerry referred to the impersonal pronoun “you” to mean the students; gramatically, this impersonal pronoun, used a second time in the same sentence, correctly and naturally referred to the students. Kerry, on the other hand, had intended that it refer to President Bush, borrowing from a previous sentence. Two months later, at the urging of vetrinarians looking for a cardiac diagnosis, he observed a videotape of a silverback male Gorilla at the National zoo, and proclaimed the animal to be healthy. Two days later, Bonzo went tits-up in his bananas, and the autopsy showed cardiac disease and anemia so advanced that a child should have been able to see it. (daddy, why is that Gorilla wheezing and clutching it’s chest?) Two weeks later, it was revealed that Frist had attempted to submit fraudulant continuing education accredidation forms to the Tennesee State Board of Medicine….without the education credits, his license to practice medicine would have been suspended. George Carlin once joked that somewhere, there exists the worst doctor in the world. I think Frist has a shot at that title.

Asking questions of an evasive candidate on pertinent issues is still valued by Republicans. Asking irrelevant questions of a personal nature of any candidate is out-of- bounds. Frank, Do us a big favor….could you please list the type questions that you believe warrant the questioner being physically thrown to the ground for asking? How violent and how far up the food chain should this behavior go? If it is appropriate to be thrown to the ground for asking a senator if he spit on his wife, How about a Governor….Would the appropriate response to asking a Governor if he sleeps with boys be a good hard kick in th nuts, followed by a broken wrist? Should a sitting president be able to have a citizen kneecapped for asking if he withheld intellegence from congress that resulted in America going into an unnecessary war?
All of you Allen defenders miss a vital point. What Mike asked Allen wasn’t the story…If Allen’s team responded civilly, there would have been no issue. The story was the RESPONSE OF THE ALLEN STAFF to the question…not the question itself.
The response to the question was out of line…and the fact that Allen did not have enough sense to tell his people to just ignore it, or let it go, speaks volumes about his character.
HE IS THE SENATOR. If he cannot control his staff enough to avoid unnecessary violence, then it leads people to believe that he is either not in control of his staff, or he condones the action.
Mike Stark is not the one running for office….George Allen is.

And BTW, I’ve never voted for George Allen, and I don’t intend to start in this election. HOWEVER, when childish people like Mike do what they did, they shouldn’t complain too much at the treatment they receive. He’s damned lucky he wasn’t arrested.

Kerry was not making a joke about the troops, it was about Bush, a person who is in a position to get stuck in Iraq or not. A soldiers education and smarts has no bearing on whether or not he gets stuck in Iraq, only a President is in that position.
