Pins and needles

I’m told the Charlottesville City Commonwealth Attorney (commonly known as ”DA” in other parts of the country) will be announcing his charging decision with regards to the events that transpired at the Omni Hotel a few weeks ago.

Since then, I met with the Detective charged with investigating the case at least twice.  I even provided him with the videotape from my personal video camera that I shot on that day. 

I’ll post again after I find out what his decision is, but until then, these are the options:

  1. He can charge the bad guys
  2. He can charge me
  3. He can charge all of us
  4. He can announce that no charges will be brought
  5. He can announce that no charges will be brought, but anyone involved is free to obtain a warrant through the magistrate

I wish I had information that would allow me to handicap the possibilities…  Unfortunately, I’m out of the loop.

Prosecutor’s statement:

The Charlottesville Police Department has completed its investigation of the incident of 10/31/06 at the Omni Hotel in Charlottesville involving W.M. Stark and campaign staff and supporters of Sen. George Allen.  The results of the investigation have been presented to the Commonwealth’s Attorney for consideration.

With the assistance of video recordings obtained from Charlottesville television stations CBS-19 and NBC-29, police personnel and the Commonwealth’s Attorney have been able to review virtually the entire incident.  The recordings facilitated the process of identifying all the participants in the events and nearly all of the material witnesses.  In addition to the video recordings the number and variety of participants and witnesses who cooperated with the investigation provide a basis upon which one may have confidence that the available evidence constitutes a full and fair record of the events under consideration.

Upon review of the evidence the Commonwealth’s Attorney does not recommend that charges be brought against any participant in this incident.  While several individuals could be charged with one or more misdemeanor offenses such as assault and battery or disorderly conduct it is apparent from the evidence that no participant sought to strike or injure another person.

One the one hand, Mr. Stark actively and aggressively sought to approach Sen. Allen for the purpose of shouting questions at him in full view of the assembled media.  In doing so he made physical contact with members of Sen. Allen’s staff and supporters under circumstances in which a reasonable person would be concerned for the Senator’s safety and unsure of Mr. Stark’s precise intentions.  A defensive reaction from one or more of these individuals was reasonably to be expected under the circumstances.  On the other hand, after the onset of physical contact between Mr. Stark and members of Sen. Allen’s group it appears from the evidence that at least one of them, John Darden, began to react with anger toward Mr. Stark because of what he was saying, in contrast with the legitimate concern for the Senator that may have influenced his initial reactions to Mr. Stark’s approach and demeanor.  Although Mr. Darden ends up on the ground with Mr. Stark he quickly releases his grasp as another individual assists mr. Stark to his feet and ushers him out of the building.  In the Commonwealth’s view, this behavior is inconsistent with a conclusion that Mr. Darden intended to harm Mr. Stark.

As much as emotions may have come ot influence the behavior and judgment of several individuals who were involved in this incident, the balance of evidence reflect that no one sought to hurt anyone.  Under these circumstances, rather than urge that cross warrants be sought between the parties to the physical altercation that took place, the Commonwealth’s recommendation is that no charges be sought by law enforcement.

    I’ve actually filed assault charges with the magistrate before. It’s not difficult. Just show up, have the names of the people and witnesses, it will end up on the docket. But, there is a risk. Probably the safest route would just be to drop it, realize it made them look stupid, and give yourself a little credit for making Webb’s win easier.

    These episodes (Charlottesville, and Augusta County) gave us yet another profile of George Allen. He is a guy that cultivates thuggery amongst his staff and either has a tin ear for political theater or thinks he is not accountable. Maybe both. In general, Virginians don’t like such unpleasantry but in this case your heat brought much light. Well done.

    Gee, Glen, change the name to “Felix”, and the same question could apply to a certain washed up has-been former United States Senator.

    What’s next on Mike’s agenda? Returning to law school for the next few years with the warm feeling of gratitude of several million American voters that we will never have to say “President Felix”.

    What’s next on the former Senator’s agenda? Hard to say, but I recon it will be something close to a donning a red vest while repeating the phrase “Welcome to WalMart…would you like a cart?”

    To continue on a little further, I’d say really its about time to ask for an apology and tell them the case will go away if they just apologize.

    Then guess what? You win, just like Senator Webb did.

    Mike, thanks for your work in supporting Senator Webb. I didn’t always agree with some of the questions you asked Sen. Allen and think some of the questions lowered the level of discourse to the GOP level, which I hate to see any discussion fall to.

    However I am elated (and conversely saddened it was so close) that there are a an extremely small majority of Virginians who saw that Webb was a far better choice.

    Allen had alot of support, from what I heard, from the troops, and while he was a tool from day one he still had passionate supporters, as did Webb. Not excusing at all what happened at the Omni but perhaps you would look like more the winner if you start now with the option of a formal apology and it all goes away.

    And since this mid term election one Senator has clearly risen above all the other freshman Senator’s and that is Jim Webb. It was not just Virginia that won that day, it was America that won.

    Thank you Mike for doing what you did. When this nation was young, our founding fathers meant for the country to be run by the people, and for the people as it should be. Since then, a lot of the people in this nation have forgotten what that means, and just handed their lives over to the politicians.

    No taxation without representation. Public servants. From the many, one. Watching you do what you did, and how certain people reacted to it, or tried to shut you up just got to me. It really showed how far from our founding fathers’ ideas we’ve strayed and how one voice can bring it all right back to what it’s really all about.

You exercised your Constitutional rights as well as great restraint when you were physically manhandled. I hope it’s at least consolation that the clown lost. I do not see how the judge would view this as a reasonable response when the (soon to be ex)Senator has a phalanx of security supposedly trained to respond appropriately and within the law.
